GENERAL SALES CONDITIONS

These conditions of sale are concluded on the one hand by SAS Diag-Engine, head office ZAC Maison Rouge 27800 BOSROBERT, SAS with a capital of 3,000 Euros - SIREN: 810 169 573 - RCS Bernay, and on the other hand, by any individual or legal entity wishing to proceed with a purchase or a service.

OBJECT

These terms and conditions of sale define the contractual relationship between SAS Diag-Engine and the buyer. The acquisition of a good or a service through our company implies an acceptance without reserve by the buyer of the present conditions of sale.

These terms of sale shall prevail over any other general or particular terms not expressly agreed by SAS Diag-Engine. Diag-Engine reserves the right to modify its conditions of sale at any time.

In this case, the applicable conditions will be those in force at the date of the order by the buyer. Characteristics of goods and services offered The products and services offered are those listed in the catalogue published on the Diag-Engine website. In order to avoid any problem when sending the ABS block, you must ensure the accuracy and completeness of the mandatory data you provide. Diag-Engine guarantees the proper functioning of the ABS block provided, regardless of the reference listed or the visual appearance of said ABS Block.

RATES

Prices shown on the site are inclusive of VAT, applicable on the day of the order. We reserve the right to modify our prices at any time, the price indicated on the day of the order will be the only one applicable to the buyer. The prices indicated include the costs of order processing, transport and delivery.

ORDERS

Buyers, who wish to place an order for a product or service must:

Put in an order on the site, validate the terms and conditions.
Make payment as provided
As part of a repair service, send us the original ABS block with the invoice in the package.

RETRACTATION

The nature of the service of repairing an ABS block does not allow the use of the withdrawal period provided by law, due to the fact that the part to be repaired is the property of the customer.

If we find that the ABS block has been damaged on arrival, making it impossible to repair it, we will charge a fee of 120€ (including VAT) including the handling, the expertise and the processing of the order.

Payment Terms

Price is due at checkout.

DELIVERY

Deliveries are made to the address indicated by the buyer by Colissimo within 48h.

In the event of damage during transport, the complaint must be made to the carrier within three days of delivery. Delivery times are given as an indication only.

WARRANTY

All services and products provided by Diag-Engine come with a lifetime warranty.

All warranty claims shall be made by email. Within the framework of the warranty, the buyer is required to return the ABS block at his own expense, SAS Diag-Engine cannot be held responsible for any disassembly and reassembly costs.

In the case of a standard exchange, the codes and options reprogrammed into the ABS Block are those present in the buyer's original ABS Block, these codes and options may have been degraded and modified by the failure of the ABS Block and no claim can be made in this regard.

All of our ABS Blocks are supplied with a warranty mark. The warranty does not apply in the following cases:

Deteriorated warranty mark
Testing the ABS Block on a vehicle other than the one designated by the registration document
Non-supply of a diagnostic sheet issued by a garage dealer of the make of the vehicle or, failing that, a multi-brand garage using a multi-brand diagnostic case.
Any intentional or unintentional physical or electrical damage

RESPONSIBILITIES

The seller is only bound by an obligation of means; it shall not be liable for any damage resulting from the improper use of an ABS Block.

Diag-Engine reserves the right to cancel an order in the event of prolonged unavailability of repair parts or the exchange computer.

INTLECTUAL PROPERTY

All elements of the Diag-Engine website are and remain the exclusive intellectual property of Diag-Engine. No one is allowed to reproduce, exploit, distribute, or use in any way, even partially, elements of the site whether they are software, visual or sound. Any simple or hypertext link is strictly forbidden without the express written consent of Diag-Engine. Personal data In accordance with the French law on data processing, files and freedom of 6 January 1978, personal information about buyers may be processed automatically. Diag-Engine reserves the right to collect information on buyers, including by using cookies, and, if it wishes, to transmit the information collected to commercial partners. Buyers may object to the disclosure of their personal data by notifying Diag-Engine. Likewise, users have the right to access and rectify data concerning them, in accordance with the law of 6 January 1978.

DISPUTE SETTLEMENT

These online terms and conditions of sale are subject to French law. In case of dispute, jurisdiction is given to the competent courts of Evreux, notwithstanding multiple defendants or appeal in warranty.
